RELEASE OF LIABILITY, ASSUMPTION OF RISK,
PARENTAL CONSENT, MEDICAL AUTHORIZATION
AND MEDIA RELEASE

Doing Business As DFW Bubble Bash and Bubble Bash 

This agreement is intended for adult participants and parents/legal guardians of minor participants. Please read carefully before signing.

1. Agreement

In consideration of being permitted to participate in any Bubble Bash activity, I agree to the terms of this Agreement on behalf of myself and, if applicable, any minor participant for whom I am authorized to sign.

2. Released Parties

'Released Parties' means Enlizable, LLC d/b/a DFW Bubble Bash and Bubble Bash; its owners, members, managers, officers, employees, volunteers, referees, instructors, contractors, sponsors, venue owners, property owners, municipalities, school districts, churches, parks, HOAs, corporate clients, event hosts, affiliates, successors, assigns, insurers, vendors, equipment suppliers and all persons or entities involved in organizing or facilitating Bubble Bash activities.

3. Assumption of Risk

I UNDERSTAND THAT PARTICIPATION IN BUBBLE SOCCER, BUBBLE FOOTBALL, INFLATABLE GAMES, TEAM-BUILDING ACTIVITIES, WARMUPS, SETUP, TEARDOWN AND RELATED ACTIVITIES INVOLVES INHERENT RISKS INCLUDING COLLISIONS, FALLS, EQUIPMENT FAILURE, CONCUSSION, TRAUMATIC BRAIN INJURY, SPINAL INJURY, FRACTURES, HEAT ILLNESS, WEATHER HAZARDS, PROPERTY DAMAGE, PERMANENT DISABILITY, PARALYSIS AND DEATH. I VOLUNTARILY ASSUME ALL SUCH RISKS.

4. Release

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, I RELEASE, WAIVE, COVENANT NOT TO SUE, AND DISCHARGE THE RELEASED PARTIES FROM CLAIMS ARISING FROM MY PARTICIPATION, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, EXCEPT CLAIMS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW.

5. Participant Responsibilities

I certify I am physically capable of participating; am not impaired by drugs or alcohol; will follow all instructions; will inspect equipment before use; will immediately report unsafe conditions; and understand Bubble Bash may remove participants for unsafe conduct without refund.

6. Parent/Guardian

If signing for a minor, I represent I am the parent or legal guardian with authority to sign, consent to the minor's participation, accept the risks on the minor's behalf, authorize emergency medical treatment, and agree to this Agreement to the extent permitted by law.

7. Medical Authorization

I authorize emergency medical care if deemed necessary and accept responsibility for all medical expenses incurred.

8. Property Damage

I accept responsibility for damage caused by me or any minor under my supervision beyond normal wear and tear.

9. Media Release

I grant Bubble Bash a perpetual, worldwide, royalty-free right to photograph, film and otherwise record my likeness and voice for promotional, educational and commercial purposes in any media, including social media, websites and future technologies, without compensation.

10. Governing Law

This Agreement is governed by Texas law. Exclusive venue shall be in Dallas County, Texas, or the appropriate federal court serving Dallas County. To the extent permitted by law, the parties waive trial by jury.

11. Miscellaneous

Electronic signatures are valid. If any provision is unenforceable, the remaining provisions remain effective. This Agreement constitutes the entire agreement concerning participation and survives completion of the activities.
